1. Acceptance of Terms

By downloading, installing, or using the Pulse application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Pulse ("we", "our", "us").

2. Service Description

Pulse is a fitness and wellness application that provides:

  • Workout tracking and exercise logging
  • AI-powered personalized workout plan generation
  • Live AI coaching sessions with voice and video interaction
  • Nutrition and calorie tracking with food search
  • Progress monitoring including weight tracking, body metrics, and performance analytics
  • Social features including a feed, challenges, groups, direct messaging, and leaderboards
  • Gamification with Pulse Coins, titles, leagues, and achievement badges
  • Integration with Apple Health for data synchronization

3. Eligibility

You must be at least 16 years of age to use the App. By using the App, you represent that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 18, you confirm that your parent or legal guardian has reviewed and consented to these Terms.

4. Account Registration and Security

To use the App, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.

5. Health and Fitness Disclaimer

IMPORTANT: Pulse is a fitness tracking and wellness tool. It is NOT a medical device, and it has NOT been evaluated or approved by the FDA, CE, or any other regulatory body.

  • Calorie estimates are approximations based on standard MET calculations and publicly available nutritional databases. Actual values may vary significantly.
  • AI coaching and workout recommendations are for informational and educational purposes only. They do not constitute medical advice, diagnosis, or treatment.
  • Heart rate data obtained through Apple Health is for reference purposes only and should not be used for medical monitoring.
  • Always consult a qualified healthcare professional before starting any new exercise program, diet, or nutrition plan, especially if you have pre-existing health conditions.
  • Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms.

By using the App, you acknowledge that you use all fitness and nutrition features at your own risk.

6. User Content and Social Guidelines

You retain ownership of content you create and share on Pulse. By posting content, you grant Pulse a non-exclusive, royalty-free license to display, distribute, and store that content within the App.

You agree not to post or share content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
  • Promotes violence, discrimination, or hatred against any individual or group
  • Contains spam, unsolicited advertising, or malware
  • Infringes on intellectual property rights of others
  • Impersonates another person or misrepresents your identity
  • Shares private health or personal information of others without their consent

We reserve the right to remove content that violates these guidelines and to suspend or terminate accounts of repeat violators.

7. Acceptable Use

You agree to use the App only for lawful purposes. You shall not:

  • Attempt to gain unauthorized access to the App, other users' accounts, or our systems
  • Use automated means (bots, scrapers) to access or interact with the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Interfere with or disrupt the App's servers, networks, or infrastructure
  • Use the App to collect or harvest personal data of other users without their consent
  • Use the App in any way that could damage, disable, or impair its functioning

8. Intellectual Property

The App, including its design, code, graphics, logos, and content, is owned by Pulse and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

The exercise library, AI coaching algorithms, gamification system, and other proprietary features are the exclusive property of Pulse.

9. Subscription and Billing

Certain features of the App may require a paid subscription. Subscription terms, pricing, and billing cycles will be clearly presented before purchase. Subscriptions are billed through Apple App Store or Google Play Store and are subject to their respective terms and refund policies.

You can manage or cancel your subscription through your device's app store settings at any time. Cancellation takes effect at the end of the current billing period.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Pulse is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
  • We do not warrant that the App will be uninterrupted, error-free, or free of harmful components
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you have paid in the twelve (12) months preceding the claim
  • We are not responsible for any health outcomes or injuries resulting from using the App

11. Indemnification

You agree to indemnify, defend, and hold harmless Pulse, its developers, affiliates, and partners from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third party's rights.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through Settings. Upon termination, your right to use the App ceases immediately, and all data will be deleted per our Privacy Policy.

13. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law.

14. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated through an in-app notification at least 30 days before they take effect. Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.
